Importation of foreign workers (MOU)

Aliens coming to work under the MOU is bringing aliens to work in Thailand under the Memorandum of Understanding (MOU) to have clear procedures and processes, reasonable costs, and efficient repatriation to their home countries when their employment term ends. Currently, there are 4 countries that have signed MOUs: Myanmar, Cambodia, Laos, and Vietnam.

Positions permitted for import under MOU

  • labor

  • Domestic service

Businesses permitted to employ foreign workers

  • Cambodian, Laotian and Burmese nationals are allowed 25 businesses, except for contract labor businesses.

  • Vietnamese nationality, 2 businesses permitted: construction and marine fisheries

Period of permission to work

  • In the first phase, work will be permitted for no more than 2 years.
  • Can be renewed for no more than 2 years at a time.
  • Total working period per time not exceeding 4 years
  • When the 4-year period is completed, if you want to continue working, you must follow the steps and leave a 30-day break.

There are two cases of bringing foreigners to work in Thailand:

  1. The permit holder is the person who brings the foreign worker in for work. The employer must make a contract for bringing the foreign worker in for work and pay the service fee and expenses (except for the foreign worker's personal expenses).
  2. The employer is the one who brings in the foreign worker to work. The employer must provide security in case of damage caused by bringing in the foreign worker to work.

Procedures for bringing foreign workers to work with employers in the country according to the MOU

  • Applications can be submitted at the Provincial Employment Office (PEO) / Bangkok Employment Office (BEM) 1-10 where the business is located.
  • Pay the application fee and 2-year work permit fee of 1,900 baht.
  • Deposit a security deposit of 1,000 baht per foreigner (in the case that the employer does it himself)

  • The Department of Employment has issued a letter to the Thai ambassador in the country of origin (Cambodia, Laos) or the Myanmar Embassy in Thailand.

    MOU labor expires in 2 years

    Visa and work permit extension services for Myanmar, Laos and Cambodia nationals to work for 2 years.
    VISA and WORK PERMIT 

    Importing foreign workers MOU will get a 2-year work permit, a 2-year visa. When the 2-year period is up, you can apply for an extension in Thailand without having to return to your home country for another 2 years, totaling 4 years. However, if the employer or foreign worker does not extend within the specified time, they will have to pay a late fee or have to make a new MOU.

    Requesting a certificate of residence for a driver's license/transfer of a vehicle/purchase of a vehicle for foreigners
    Resident Certificate Application Service

    Foreign workers working in Thailand who wish to obtain a driver's license or buy-sell cars or transfer cars are required to apply for a certificate of residence to show that they actually reside in Thailand. The certificate of residence can be applied for at the Immigration Office in the area where the foreigner resides.

    Documents required to apply for a Resident Certificate
    Homeowner's documents as stated in the residence (if it is a title deed, it cannot be submitted)
